Telecommunications Act 2023: A Shift in India's Telecom Regulatory Landscape


The Telecommunications Act 2023, officially published on December 24, represents a major overhaul of the legal framework governing telecommunications in India. It replaces the long-standing Indian Telegraph Act, 1885, and other relevant laws. Before being presented in Parliament, the government conducted a public consultation in September 2022 to address concerns raised in the initial draft, including issues related to Over-The-Top (OTT) services and penalty structures. The Act received Presidential assent after approval from both houses of Parliament, marking a significant shift in the regulatory landscape for the telecommunications sector.
